New York (AP)-Prosecutors said they are now expecting a music tycoon Sean of Didi Combs to face prison, “significantly higher” than the four to five years, once they think he is likely to face two prostitution allegations.
They made the observation at the end of Thursday at the Manhattan Federal Court of the Federal Court of A written submission, in which they also opposed the Combs’ request to be released on $ 50 million this week while he was expecting a sentence on October 3.
At the beginning of July, the 55 -year -old Combs was justified for a racketeering for conspiracy and sexual accusations carrying potential prison conditions, but was sentenced to two censuses for transportation to join the prostitution of arranging girlfriends and male sex workers to travel to participate in sexual meetings.
Any prostitution -related prosecution brings a potential maximum prison.
Prosecutors said after the sentence that they believe the federal sentence guidelines that mean to prevent widespread differences in the sentence for the same crimes are likely to require a prison of four to five years. But they said on Thursday that they believe that the range of guidelines “would be much higher”, raising the risky combs would escape.
Judge Arun Submanian will have a wide width in determining a sentence and may choose to ignore instructions that are optional. CombS lawyers said they believe the instructions, if properly calculated, would require 21 to 27 months in prison.
On the day of the sentence, prosecutors won a guarantee battle after defense lawyer Mark Lambie claims that Combs should be released immediately on bail.
Submanian denied the defense application, stating that Combs had failed to comply with the severity of display through clear and convincing evidence of “lack of danger to any person or community”. But he said Agnifilo could renew the request.
Doing this on Tuesday, Agnifilo cites other cases, for which he said they were comparable to the CombS sentence in which the defendants receive a guarantee. And he quoted difficult conditions at the Center for Detention of the Sofia Arrest in Brooklyn, where a combs was held after his arrest in September at a hotel in New York.
He also said that Combs are treated unfairly for being engaged in a swing lifestyle, in which he and his girlfriends sometimes invite male sexual workers to join them in multi -day marathon sex performances.
Prosecutors stated in his submission on Thursday that Kombs’ verdict on prostitution -related census bears a mandatory requirement for him to remain in prison before the sentence, unless he could prove exceptional circumstances that he said he could not.
They said that he should also remain in prison as a danger to the community, the claim that lambo disputes in his documents.
“Sean Combs will not be violent to anyone. As we said in court, this court hearing has returned his life and he will not waste his second chance in life, nor would he do anything to threaten his seven children who have no father, and four of his children have no parent at all,” lambo writes this week.
Prosecutors also said the conditions in the federal lock had improved significantly before Kombs was arrested. A federal judge in January 2024 blew up prison conditions, including its extensive locks and inadequate medical care.
Prosecutors said the cases cited by Agnifilo, in which other defendants have received a guarantee are not comparable to the crimes that Combs have been convicted of committing, especially because of his tendency to violence.
“The vast history of the defendant’s violence – and his continuous attempt to minimize his recent violent behavior – demonstrates his danger and that he is not profitable for supervision,” they wrote. “The defendant is completely unable to establish through clear and convincing evidence, as it is required that it does not pose a danger to the community.”
