ICE confirmed Burke’s detention, saying that all persons in violation of the US Immigration Law may be the subject of arrest, detention and removal from the United States, regardless of nationality.

The customs and border defense of the US did not specifically comment on the case of Burke, but noted that people traveling under the visa refusal program were forbidden to work for all kinds of compensation, including work in exchange for a room and advice.
